A judge can make an order for one person to pay another persons legal costs in divorce.

I have just come across a judge that was willing to make this order, but believed because I was bankrupt that the money granted would go to the official receiver instead.

The judge asked me if I knew if this would be the case. I did not know the answer. So the judge would not make the order.

A couple days later the official receiver confirmed that provided the order was for stbx to pay for a solicitor for me direct to the said solicitor they would not touch the monies awarded. As it would help me get a fair hearing.

Unfortunately it was too late for me, but this information may help someone else.

Yes, costs can be ordered by a Judge.

However this is a gamble of sorts as its not guaranteed at the outset.

Just to be clear, what Fiona and I were talking about is not a costs order but an order for one partie to release funds to help with legal costs, sounds pedantic but the two are far from the same.

From memory you applied for a maintenance pending suit, interim maintenance, not what Fiona is talking about, I can understand the confusion though, family law is strange isn''t it.
