• Each party to the application for parenting orders or his/her lawyer must complete a separate annexure. Please refer to Consent Orders Supplement for use in parenting matters where proceedings have already been filed in the Family Court (Do it yourself kit).

• Staple the annexures to the back of the original of the proposed consent orders signed by the parties.

• Part B must be completed by the person who signs the annexure.

• Part C is only completed where there have been allegations of abuse.

This kit can be used to apply for consent orders about:

• the care, welfare and development of your children (known as parenting orders);
• the division of property or maintenance for a spouse/de facto spouse or former spouse/de facto spouse (known as spouse maintenance).

This document contains the proforma consent orders that are to be typed and filed with the Court where there has been an agreement reached either on an interim or a final basis in existing proceedings for parenting issues before the Family Court.

• The cover sheets and orders must be typed in full
• Read the "how to apply" steps in the kit carefully
• The original signed consent orders must be lodged together with two certified copies
• Both parties must sign each page of the consent orders
• The details required on the covering sheets are enclosed in brackets eg (information)

This form has been prepared by the Court where consent is required for less adversarial trials (Division 12A) to apply to a case.  Such cases involve:

• any application filed before 1 July 2006
• the following applications filed after 1 July 2006

- where you are asking the Court to make orders about financial matters as well as about the child(ren) consent is required to include the financial matters

- where you are asking the Court to make orders only about financial matters

Cases which involve an application filed after 1 July 2006 asking the Court to make orders about children do not require consent as the less adversarial trial apply automatically.

When do you file it
A consent is filed in those cases described above when directed by the Court.

You use this questionnaire when your case goes to a trial before a judge and the filing of a 'Questionnaire - parenting' has been ordered.
