OK, separated 6 weeks. He wants an immediate divorce, you don't. He has 2 options for a 'quickie' divorce
1. Adultery - he has to prove that you have committed adultery, to a judge's satisfaction. WIthout an admission on your part, hard to prove.
2. Unreasonable behaviour - This can be virtually anything - she doesn't communicate, she doesn't fold my socks up right, lack of intimacy, constant arguing .... THe list could go on forever.
Unreasonable behaviour is a tricky one, as what is unreasonable to me, may not be unreasonable to you. It is very subjective.
The point being, if he pushes hard on unreasonable behaviour, it is virtually impossible to stop the divorce happening.
It is clear from what you say that he wants to get on with it and doesn't want to wait for a 2 year by mutual consent divorce. Incidentally Saffy - the 5 year one is for divorce without consent.
How old are your 2 sons? If they are under 19 years, the court has to consider their housing needs as paramount. That means that any financial settlement for you and your boys must take account of their housing needs, and as thte Parent With Care, your housing needs too.
Have you looked into benefits? Are you working? One thing you can do quickly is to get yourself an appointment with the Citizen's Advice Bureau and have a benefits check. In exceptional circumstances you might be able to get your mortgage interest paid.
SO all is not lost yet.
I would reccomend that you try to get a free 30 min appointment with a solicitor that SPECIALISES in divorce, or family matters. THat will at least give you an idea of what might be achievable.
