My wife and i blew 12K on collab and she pulled out.
She filed a form A and appointed a bulldog solicitor.
I decided to self rep and use a sol as a sounding board.
Cost up to First Appointment is about 1000. My wife has spent about 2000 using a sol i think, no form H sighted yet.
My Form E is very claer and very detailed with full back up all x referenced and so detailed, hers is awful and i have had to file a questionnaire. They are now beating on me saying I am delaying the process as they wanted to go to FDR without FA but my issue is her from E is shot.
She has not disclosed at least 2.5K income and then she has overcooked her future needs.

So is self repping a good idea I think so

I have had quite a bit of correspondence with Amanda ( divorcelawyer ) now taking a break for the saddest of reasons, and her view is that, when it comes to family law, there is definitely something rotten in the state of Denmark.

Amanda's view was simply that the existing rules are not
properly enforced. There are time limits, and they should be kept to ; Court orders should be complied with, and on time ; and there should be a much greater readiness to award costs against litigants who are playing silly beggars. Amazingly, there were solicitors in practice still making Calderbank offers.

In many other areas of law which I know better than divorce, there are inflexible time limits and you disregard them at your peril ! If that happened in divorce law, then
solicitors would have to play the game by the rules or
they wouldn't last very long.

So whose fault is it that time limits and court orders are not adhered too?

Clients blame their Lawyers, Lawyers blame their clients and Judges just dont seem to care?

I think if just ONE Judge made a point and actually enforced some of their orders with severe penalties, then word would get round and make everybody sit up and take notice.

One lady has just written to me asking about a Calderbank letter she has just been sent by her s2bxs Lawyer, I am amazed and my reply was "The without prejudice, save as to costs bit at the top of the letter is probably so that she can not show it in court at a later date as they might just be a tinzy winzy bit embaressed by the Judges reaction!

Mmmm I wonder if thats where we should all start campaigning, lets abide by the rules and time limits and make Judges apply penalties where needed, maybe we may all just get somewhere with all this divorce law. Where and whom do I write my petition to though? And will anyone sign it? Mmmm I wonder................

I've just had one of those two days ago. They make their griping points hidden behind those words....

I know if it did come to Courts attention; they'd then hide beind the ex, blaming him.

They say "against their advice ...ex will offer you two doughnuts and half the donkey"... (or words to similar effect)
Now if they're not working in partnership with him; then what's the point in him using their services???

They keep writing saying that he wants things sorted as quickly and cost effectively as possible. But then do nothing but write more expensive letters saying so. A year on... and they're still not considering my contributions; but still writing rubbish!

Just after a bit of general advise. It's early days for me, but i was wondering if my ex and I agree on the finances etc can we just fill in a consent order, maybe get solicitors to give it a quick once over and then hopefully get it approved through court - or do you have to fill in form E and get all the supporting bank statements etc to submit with the consent order.
My ex and I haven't agreed to anything yet and we may very well ending up going down the expensive route of solicitors,first and final hearings but it would be nice to think if things could be sorted out quite amicably then it's worth a bit of compromise to avoid huge court costs.
any advise please
