Exchanging Form E's 2 Months ago
|
|
A question about exchanging Form E's. This may have been answered elsewhere; I have searched but couldn't find one.
I am self-repping, and my question is how do our respective Form E's physically get exchanged?
Do we agree a certain date for the exchange?
Or do we have to meet up in a darkened car park with form E's hidden in brown paper bags?
No specific date has been requested for my form, any letters from her Sols merely state that it should be completed and returned 'as soon as possible'.
Should I propose a date for the exchange or just send mine in and wait?
Thanks

That made me laugh father in a dark car park
Am not sure if myself and ex done it the right way cos everything felt back to front.
He was self repping and he sent his form E to my sols in the sept 06 i had a dead line date i think it was 14th June 07 and that was ordered by the court.

You need to take your Form E to the court and swear on the bible or something else, depending on your beliefs.
You then go to your favourite photocopier (Staples is cheapest if you have to pay for it! ) and get 2 copies of the whole thing (all 24 pages and enclosures ).
You then buy some thingies to make sure it all stays together!!
You send one photocopy to the court manager.
You then write to stbx sols saying you are ready to exchange form e's ( do NOT send yours at this time )
Form e's should be exchanged contemperaneously (at the same time!! ) so neither of you gain any advantage so you arrange an exchange either by post or in person at the sols office.
You keep the original for your files.
Then when you get her form E you have a stiff drink before you open hers!!
As long as you have been totally honest you will be fine, if she hasn't she will be caught out.
Stay calm, this is only the first step!
Take care

The previous responses apply if you or spouse have applied for ancillary releif through the courts.
The courts will dictate by which date the exchange needs to take place, depending on when Form A was submitted to them for ancillary relief.
If you are doing a voluntary exchange you won't need to copy the court and may want to use different tactics regarding timing.

I am self repping, I am not an expert, and I am frequently found barking up the wrong tree !!
Please therefore seek proper legal advice, before acting on mine...................

Thanks for the reply Spooky.
Poppy,
Neither of us have applied for ancillary relief, so the court itself has not set any dates. We are currently doing all this voluntarily.
What other tactics could be used, and why would I want to do anything other than just exchange the forms?
I can understand that the court may not need to see the completed form immediately (or until such time as it does go to court).
Having now actually got into completing the form, I would rather get them done and exchanged as soon as possible.
Thanks

Hi FO3
All you do is give her sol a call or drop her a line proposing a date that you each put it in the post. That's it!

Re:Exchanging Form E's 1 Month, 3 Weeks ago

As predicted I exchanged my Form E through the court and wheres his...? Nowhere to be seen - Theres a surprise. So now I suppose I just have to sit and wait whilst he prepares his documentation around mine - or not as the case maybe.
Will there be an advantage to him seeing all my info and the back up documentation before I see his? And now what? I have to contact the court and say that I haven't had the info required for the court hearing in a few weeks and wait some more. Reality check tells me this could go on for months. I'm hoping that the judge can tell him for what he is and look favorably on me sticking to the court timetable.
Question - can I still go to court and ask for an adjournment whilst asking for a set time - say 14 days - for items and Form E to be submitted by him to me. Can I ask them to attach a penal notice to that request?
I just want some compliance, not for satisfaction, just so I can get on with my life.
