My estranged wife is in the family home with her new BF (involved in split). She has systematically evicted my personal belongings whilst he as good as lives in the house. Every night nearly, breakfast with my kids, tea, every day almost. Is this near enough for cohabiting. He rents a house and is supposed to be 'moving in with his mum' lol. He is even moving some of his furniture in. I moved out to give her time to think then exposed her deceit. Its nearly 3 months and I'm going mad and feel it is so obvious but what can I do?

If your name is on the mortgage you can give her a fright or confirm your thoughts by turning up and either checking through the wardrobe, bathroom for his personal items or telling her that you are moving back in, today and see what she tells you about her living arrangements.
sounds cruel I know but at least you will know once and for all if he has moved in, you will also be able to check for any post with his name on it.
if you want to be a bit more subtle you can do a credit check and see if he i done as associated to her at that address.
the choice is yours.

It seems obvious to me that they will claim he lives elsewhere and not compromise any settlement.

He has clothes and toiletries at the house, she cooks his dinner etc. He spends the majority of his spare time with her. They have even moved his bed into the main bedroom!

how do you prove this??...sit outside n watch the comings n goings???....my husband i think has moved in with a g/f ..i have lots of circumstantial evidence but no real proof as to how many nights he stays there...your wife has a lot of front if he has moved in and it must hurt especially him being with your kids....stick with this site ...some one will have the solution....dawns idea is good..id love to take my kids to their dads new home n drop them off on new g/f...lol..i wouldnt of course but i do imagine the scenario and it cheers me up no end...

hi, my ex has been cohabiting for the past 16months but she denies it even though my 17yr old son left home because of it, she tells her sol lies, son picked up a couple of envelopes eith bf name and mh address on, sent these to my sol, its very hard to prove that someone is cohabiting my mother advised me to get a private detective to take photos and i laughed and told her she watched too much tv but i wish id done that now, i only hope sols and court take notice of envelopes, thanks dave

if a former husband is living with a new partner does this impact in any way on their need for a new home....??? my husband wants me and the kids to sell up and move out....i could not afford to rehouse us in the area we are in now if husband gets the money he wants from sale to rehouse him...any comments or your own experiences would be read with interest....thank you....daisybell..if new b/f's mail is going to the house it must prove something...surely...i too btw have thought about a private detective but sol advised dont waste money on that
