You work for 30 years, you build up a pension. Being a Teacher's pension it is contributed to by the county council. It is a good pension.

Now this has got to be the most outrageous outcome.

Your wife or husband whichever you wish to allocate, has an affair, wrecks your life, and the childrens. Sits back and is awarded all and sundry for her cheating actions, at the same time not contributing towards the mortgage endowments, children etc.

She is awarded a share of the pension, which is not received until she is 60. BUT we have just been informed that if she died before that age, she is 47, the contributions currently being taken from the monthly pension, as this pension is already being received, WOULD JUST DISAPPEAR. Puff!!!! up in smoke with a swish of the magician's wand!!!!!!
It is not the case that if she is no longer receiving £300 odd pounds per month to go into her pension pot, it reverts back to the pension holder. SO where does this money go.
No-one knows. We were told, 'dont know presumably it is shared amoungst other pension schemes.

SO you work all that time and just because your wife cant keep her knickers on, YOU ARE PENALISED YET AGAIN. Someone else is going to benefit from that money which in our case amounts to £50,000. I am sorry but that is tantamount to theft in my eyes.

If there is a cause for change it has got to be that on the death of the pension sharer, it will revert back to the holder. It is outrageous and yet another stupid rule which needs to be addressed with urgency.

So you lovely people out there, you innocent parties, not only do you have to suffer, the stress, loss and all the other horrible situations that divorce and cheating spouses throw at you. You are now subsidising other people for your cheating partners actions. All your money, up in a puff of smoke

How lovely well done UK and the systems that really bear no relation to fairness. What a complete load of rubbish.

And if she does reach 60, her new bf/partner/husband will be quids in. WOW.

Belittles the respectable human beings in this country.

So not only does she stand to benefit tremendously from her affair, she then becauase of that affair still carries on screwing the innocent party to the floor, even though she is still no longer around. I just hope she lives until she is 60!!!!!!!!!!!!!!!

WHAT is going on with this country.

I think the worst one I had was an Army colonel, who bless him, as a field officer had really worked for that pension - his wife who had cancer was awarded a pension share. He offered maintenance for her lifetime to no avail - he watched as his pension pot was disspiated for someone who was in all likelyhood not going to be around to have the benefit - and as he said - the Army had had the best of his life and were now going to benefit by not having to pay his full pension. Sadly by the time we got him he was out of time to appeal and leave was refused

Sounds about right though if it's totally unfair and ridiculously stupid it must be legal!!

When the consent order is written agreed and stamped, why is it not a statutory clause that this will revert??

Surely, since now divorce automatically includes pension sharing, it is not included and provisions made that if the pension sharer dies it reverts. It really is not rocket science. I wonder how many on here have even thought of this situation.

It is just becoming a 'punch the victim when he is down society'. It would not be quite so awful if it went to a good charity!

Or are there clauses that can be included in the consent order, but just not used?

To my knowledge there are no reversionary clauses that can be put in - maybe Peter and I need to knock heads about this and see if we can come up with something .

As for a statutory scheme of reversion, I think that is only right - again, maybe Peter and I need to knock heads about it and see if we can come up with a little campaign to hit the public with.

Wey hey go Amanda,

Count us in on that, we will definitely help campaign, we know it is probably too late for us, but would like to help if it will make life easier for anyone else.

My husband is going to see his local MP and see if we can bash anything out with him, yeah I know, bash head against brick wall But it will only change with people power.


Hopefully Peter will be able to point a few items in the right direction too.
