Hi, I'm 45 & am living in the family home with my 3 children. My wife left us all back in January. I am disabled and have just been Medically retired by the company I used to work for. It's a very modest pension of £3500 per year which is guaranteed until my death ( I had to sign a waiver of a full pension should I be medically retired because of a pre existing condition when i joined the pension scheme). I also receive DLA at the higher rate plus Incapacity Benefit and also a CSA payment from my wife of £200 pm. I pay the mortgage and all the household bills. We also have a holiday home valued at £105,000 for which my stbx pays most of the bills whilst our home is valued at around £120,000.She refuses to sell the holiday home whilst my sol says it should be sold. The holiday home was bought with compensation from the NHS as were some shares , PEPS and ISAS and the rest of our savings.How much of my pension can my stbx claim and would it be wise to take a tax free lump sum from it before the divorce is finalised? Would I get sum of her pension and when would I get it? I need to know because I'm withdrawing an extra £200 from my savings every month just to live and I don't really understand the whole Divorce "thing" as I'm in constant pain and on strong medication. My Sol has been great but I can't remember half the stuff I'm told.
