X2B wanted mediation to sort out financials. I went to my individual appointment and following this it became clear that as X2B would be voluntarily disclosing assets etc that he would be tempted to lie about everything and would not get a clear picture of exactly what he has/hasnt got. I spoke at length with my solicitor about this and decided that I would not attend mediation with X2B as he would probably "bully" me outside of the mediation appt to settling at a figure and then hold me to it. Now X2B has issued Court proceedings for ancillary relief (which I was going to do but again he got in first!!) and is saying that his solicitor has told him the Court will find in his favour as I didnt attend mediation. This is opposite to what I have been advised!! I was told mediation was voluntary as we are both private paying clients (not Legally Aided) and as such I had every right to decide not to attend. Does anyone know the answer? GKx

Thanks Amanda. He is really frightening me with things that he is saying and so convincing when he does that I believe him. I know I should doubt everything that he utters but he is such a powerful controlling person. He even tells me that its advice he has got from his solicitor to enforce his point. I realise that his solicitor is only as good as the information she has from him but cant help but wonder why she cant see through him for the liar that he is. He still continues to live in the MH which is totally unbearable but is adamant that he is not going anywhere. He even told me that his girlfriend had sold her house and was going to buy my share of the MH. I have asked my solicitor to enquire exactly what his position is on buying me out as I cant make plans either one way or the other whilst he is dithering. I feel quite mixed up and a mess at the moment and having problems concentrating and focusing on the finish line. I would so like to move on but feel like I have one foot nailed to the floor - if you know what I mean. Anyways - thanks again Amanda, so grateful to you. GKx
