hi do, you need to give a lot more details for others to be able to help you. Such as length of marriage both your age equity in house your income partner income both your health children, their age pension of both.
good luck

Rite here we go a few more details regardin my question from yesterday : I have bin married for 11years, we have 2 children aged 6 and 9, I live in the marital home and my husband is about 2 move in with his girlfriend into her 4 bed house with her 3 kids (under 9 ). He earns approx £41k per annum, I earn £240ish a month term time only and recieve working and child tax credit as a consequence. He wont go 2 mediation I have asked more than once !! He wants 50/50 split on the equity of the property when it gets sold in years 2 cum. He will accept 60/40 split but I feel it shud b 70/30 but have bin told by solicitor that if it goes 2 court it cud cost 8-12k !!! We both have pensions his prob better than mine but of no real consequnce as far as I no. Is it wise 2 go 4 the 60/40 split? ( he does also pay me maitenance and at the mo half the mortgage but wants 2 stop that and put it in2 my name)

marriaa wrote: equity in house pension. If he won't go to mediation; then your only route would be through the Court. This could cost many tens of thousands, many costing £30,000 plus; if going to a fully contested Hearing. You cannot "know" that you would get 70%-30% You may have been advised that. It's no gaurantee.
70%-30% is not unheard of, and not unrealistic, but you'd have to weigh up the cost of fighting it. Is he offering to continue with spousal support?
