Hi all, am new to this site and am after some advice if possible.
My husband divorced ex some 10 years ago after a 4 year marriage. They have one child together who is in junior school. Consent order was arranged for SM for life and husband was told this was the norm (?)....now ex has a career, car, purchased own house etc and seems to be managing very well. We now have two children together....have been told he has good case for having SM dismissed completely on account of short marriage (under 5 years)....any advice?

You can apply for a variation or dismissal of SM.
The case will be heard like a mini version of the original ancillary relief case.
The court will look at the current circumstances income/outgoings etc.
From what you say it sounds like you have a good chance of success.
The risks to be aware of are :
1) the legal costs
2) the amount can be varied up as well as down (though that sounds unlikely from what you say)

hi DBNO,
Can you try this one for me. X has applied for reduction/dismissal of joint lives SM of £800pcm. He earns £155,000 gross p.a I earn £12,500 pa but with WFTC, CTC, SM, CM and child benefit it goes up to £40,000 net pa. I work 20hrs a week and have 4 kids 17,15,13 and 12. My house is worth £175,000 mortgage of £80,000, his house worth £650,000 mortgage unknown as yet. He has remarried, she has one child.
He has now offered via solicitors, £400 pcm until 2016
Any ideas xxxxxx
