Acknowledgement of Service 5 Months, 2 Weeks ago
|
|
Dear Members,
I have received the divorce petition 5 days ago along with statement of arrangement for children and notice of proceedings. I also have to submit the acknowledgement within 7 working days and 5days have already elasped.
I would like your advice about how to answer part 1c, 6 and 7c of the acknowledgement of service.
Part 1c, I do not agree with her statement but want the marriage to dissolve.
Part 6 about paying the costs of the court proceedings - I do not know how to answer this part and finally
Part 7c, I do not agree with her arrangement, therefore can I say I will send my arragements later on.
I look forward to your advice asap
Best regards Sunny

Hi there
I think you are a little confused about 1c - this is not the grounds for divorce, this is why she says the cout has jusidiction to deal with the case - on her petition you will see that it will say something like "the petitioner and respondent are both habitually resident in England and Wales". If whatever she has put on the petition is right about where you life, you put yes on 1c.
For 6, has she claimed the costs on her petition? If not you put "none sought". If she has and you object, say so.
For 7c if you are unhappy with her statement of arrangements you can file your own with the acknowledgment.
And finally, if you do object to the reasons she has put in the petition for the divorce, you write in box 4 "I do not accept the particulars as true but I do not intend to defend the cause".
