Husband has just informed me he has stopped his wages from going to our joint account and has 'decided' that he will pay me a monthly amount. Not happy about this as he has'nt discussed amount or expenses with me and he is extremely ill under psychiatric care.

Can he legally do this?

unfortunately unless your husband has been sectioned he can put his wages into whatever account he wants to.

he is obviously well enough to earn a wage. You didn't say what circumstances you are in!

The obvious question is whether he has sufficient mental competence to run his own affairs.

Do you know if an enduring power of attorney ( EPA ) had been signed by your husband and if so in whose favour ?

Failing that, someone needs to make an application to the Court of Protection for the appointment of a receiver.

Being ' sectioned ' is a shorthand way of describing a situation where a person can be compulsorily detained in hospital for treatment and in many cases the stay is of short duration, for example 28 days. This is a separate issue from that of mental competence.

As Lady in Blue wondered, if he's ill then where's the wage coming from; but of course he may be on extended sick leave. It looks as if someone is going to have to take over responsibility for dealing with your husband's affairs, but much depends on the medical evidence.
