Does anyone know if a property is to be bought from a settlement, does the legal aid charge have to be paid BEFORE property is purchased or can it still be put as a charge on a newly purchased property?

Im sure it has to be paid from the monies received on sale from the property the charge was registered to.... i dont think it can be transfered to another property.

if the legal aid is in relation to the proceedings which include the house sale and the settlement is needed to purchase a property then as far as i am aware the charge is put on the property that is bought,,,,,,bit unsure about which way round the question is.

I'll try to be clearer
The situation is: FMH will not be sld BUT there is cash available to hand over to stbx ... which he cd use to buy a property. Does he have to pay legal aid bill firstthen use rest to buy. OR can he buy and have legal aid as a charge on new property?

Legal aid may be paid back via a charge on a property that is purchased after settlement.
See the document below.. If you recover money, and wish to buy a home with this money, we may be able to let you pay back our charge later.We will register a charge on your new property to make sure you repay the money eventually. But we cannot do this if you are able to repay at once without risking losing your home.
