My solicitor is unsure whether or not I will qualify for legal aid - my husband transfers to my UK account approx £3000 (fluctuates with currency exchange rates) at the end of each month. This is to cover the mortgage £2200 and endowment £200 and what is left is my "allowance". I do not work having given up my job 18 mnths ago to start our new life abroad! We do not have any children. This arrangement was done to avoid possible problems with money transfers and to avoid additional banking fees. It was also done before he emailed me for a divorce! Is it likely that they will regard all the money as being my income or just the bit he sees as my "allowance"? I have tried to read up on the subject and use the calculator (keeps going round in a loop!) and am none the wiser

Hi Rosie You need to see somone at CAB or ring Communit Legal Services. U should be entitled to benefits if ur not working.

Thanks for the advice - I have a free consulatation tomorrow which I hope can answer the questions that my solicitor couldn't. As I have the "allowance" from hubby I am not entitled to any benefits or assistance with payment of council tax etc.

Hi Rosie,
I agree with lillyann that you should see the citizens' advice bureau. But before you do, may I tell you that - should you not have British nationality - there are restrictions on any benefits that you are entitled to. It depends on the visa that you have. Just thought I'd point this out.

Thanks - we are both british - we moved abroad with his job. I know that I will not qualify for any benefits but dependent on what they class as my "income" i.e all or part of the monies he sends then I may qualify for some legal aid. Lets see what they advise tomorrow.
