If I rely on being his spouse as my right to occupy the home - does this mean that once the divorce is granted, I no longer have a right to remain and can then be evicted?
As much as I would like to stay in the home, I don't want to stay at the cost of having to still be married to him.

I am not a legal eagle, but the divorce court will consider the needs of your children first and their being provided with a home is paramount. That will be the overriding consideration, above anything else.
I think you need some decent legal advice asap.
