I e-mailed my ex's solicitor 10 days ago to accept my ex's offer to contribute to the cost of petitioning him. She responded the next day saying she was awaiting further instruction from my ex.
He and I have had several conversations over the phone about this, and he said he would be instructing her to send off the acknowledgment. I haven't received anything from the court yet. If nothing comes through by tomorrow, is it a case of phoning the court to see if they've received anything before asking the court to consider the petition served? Is there a time limit on how long I can leave this? And could avoiding acknowledging the petition mean my ex can simply file his own with the court?

Luminous, some sols can move at snails pace. If you contact the court next week to see what they have received, and they haven't, then post again. There are ways to ensure service, or to ask the court to set aside the need for service. But if things re still reasonably civil, try to keep them that wayrather than revving up the legal route.

Hi Mike
I'm sorry to go over this all again, but I'm anxious because after next week, he is going on holiday(again) for three weeks.
Our relationship has improved, but my ex doesn't do anything unless it is going to benefit him somehow. If I have to wait it out, I will, but I'd really like to get things moving and know where I am.

OK Luminous, You could contact his sol and say that unless the acknowledgement of service is forthcoming in 24hrs, you will have no alternative but to seek bailiff service by the court, as the delay is causing you undue stress. DO it through his sol so that it doesn't give him the opportunity to get the huff with you.
If he still doesn't play ball, there is the 'deemed service' route, but that takes a little longer.
