Hi..

I'm hoping someone can help. I have moved out of the matrimonial home as I could no longer live there. (Due to her aggresive behaviour and constant harrasment)

However, I am now being told by her that I cannot return to collect my belongings and that I need to arrange access with her to collect my belongings!

Can anyone advise if this is the case as my name is on the deeds for the property. Must I arrange access?

We have been through this just recently, well it has not quite completed yet!!
You can write a letter to your ex, the property address, recorded delivery, informing her that you will be coming to the property in seven days time date to collect your items. In the meantime go to your local police station, and inform them. They will accompany you, if they have the man power, to avoid any breach of the peace.
If not they will be able to advice you accordingly.
We found the police very helpful.
Do you have any restrictions on not being able to re enter the property?
It is best that you do not just turn up, as this could cause problems, then you will have the police 'avin' a word with you. Hope this helps

hi fedup youre in the same position as myself, leagally we cant be locked out , my stbex has changed the locks, i told my sol he said dont rock the boat just leave things but now ex trying to take me to the cleaners, i pay mortgage while her and bf live rent free, you are by law able to go for your belongings hope she hasnt changed your locks, you can as police to go with you, at least thats what i was told, its s##t for us blokes my ex wouldnt even let my son in hes 17yrs he left didnt like her new bf, good luck, dave

I find this strange as i have been unable to get my husband or ex to be out of my house for the last year as it is his matrimonial home even tho the house is in my name only and i pay the mortgage I have been pursueing this thro the divorce courts now for nearly a year and he is still laid on my sofa in My house !

I think my next cause of action will be to arrange access through the police as I have just received an agressive text message from her indicating that there will be a breach of the peace should I arrive at the matrimonial home.

I must say that moving out was my choice to manage my stress levels. I didn't for one minute envisage that she would be able to restrict access to the house.

I shall also be consulting my solicitor regarding this and post the advice up here on Monday when she returns. Hopefully my solicitors advice will make the situation a little easier for anyone in the same position that reads it.

At least you have the text message, so she is contemplating a 'fight'. Just make sure that you do get a police escort, but do not forewarn her that that is what you will be doing.

hi this happened to me recently and although i know its his house too it was very distressing when he just waltzed in and began going through cupboards and drawers..ive never restricted his access just asked that he phone first....its only polite...perhaps you could get a third party to go with you to difuse the situation..try that then get police and solicitors involved if you have to ..if you do all in your power to keep stuff amicable then she is the aggressor
