I'll phone my solicitor in the morning and see if he can recommend a property lawyer. I've come this far I'm not going to let them kick us out now.

I just hate the fact that every time ex sees the kids at the weekend he sees them at his parents house (that's where he's living now). It really grates on me that they play the doting grandparents when they're spending a lot of time and money trying to make the kids and I homeless.

Your situation is quite the nastiest situation I've read on this site in over a year!

Maybe it's time to confront his parents and ask where they see their beloved grandchildren being raised? How suspicious of him to asign the home to them BEFORE the wedding!?

The fact that his housing Needs are met elsewhere puts you in a better position; he can't claim he needs to sell to provide a roof over his head.

Insurance Companies do offer protection against certain Legal situations. (Mines incorporated into the General House Insurance with Direct Line)

However; this does not include Matrimonial cases. It might be best to state that you're occupying a home that belongs to your in-laws. (Which it looks like is technically true) Direct Line use a legal serive that calls you back (to ascertain if your Case could be covered) ....... no idea how other companies work. It's worth a try; but don't want to build your hopes up.

If you do feel harassed and intimidated by either your ex or his parents; it could be worth asking your solicitor to write asking them to stop this; or threaten legal action.

I think I may have your answer.

'Where proceedings for financial relief are brought by one person against another, the Court may, on the application of the first mentioned person :

(b) if it is satisfied that the other party has, with that intention ( ie to defeat a claim for financial relief ) made a revocable disposition and that if the disposition were set aside financial relief or different financial relief would be granted to the applicant, maka ena order setting aside that disposition '

A reviewable disposition does not include a bona fide sale.

There is a rebuttable presumption that a disposition within the last three years was made with that intention; it may be that he has waited for just a wee bit longer than the three years before revealing it. Personally, I think that is rather too obvious ; I just can't see a Court falling for that one. The very fact that he has produced at at this time to me is more or less conclusive as to his intentions.

The Courts are very reluctant to allow trusts to be used as a means to defeat financial claims by spouses, and a certain Mr John Charman recently found that out to his cost.

The home insurance is in their name though, so I think there would be a conflict as any legal cover would probably cover them instead of me.

My solicitor said I might get legal aid to fight to get back the £6k that i paid for the kitchen.

However I'll be on the phone first thing about seeing a property lawyer.

mike that helps enormously. Our third wedding anniversary was the 6th August. He produced the deed of trust today. Prior to this even his solicitor had not seen it. Her first knowledge was 1 hour into the mediation session

it sounds like he may be "done" for attempting to dispose of assets in order to escape his liabilty to me as his wife. God I hope so.....

I'm feeling a bit more positive now.
