i had my first hearing in march and the outcome was that i took on all the matromonial debt and pay my ex £13k and she signed the house over to me. i had a provisional re mortgage to do that so i thought it was all sorted. but when the application for re mortgage went through i was turned down on account of a bad credit rating because my ex had not paid anything towards the marital debt. a friend has lent me the money to clear the debts (which i have done) i went to the solicitors with a cheque to pay my ex and the sol said i could not do it and i had to get in contact with the mortgage company to get the equity swapped to my solely my name (mortgage is up to date as i was paying it)i asked the sol why she or my ex's sol was not doing that as the agreement was i pay my ex and she signs it over. my sol got her stroppy head on and i asked her what i was paying her for as i am doing all the work that i am being billed for. i went to the mortgage company who said why as the sol not done this and why i had to do it. she explained that because of the bad credit rating incurred by my ex that they might not be able to change it solely to my name. i am waiting for a decision.
yesterday i recieved a letter from my sol saying i have to go for an urgent directions appointment because i have not paid my ex a lump sum so she can then transfer the property to me and all her interest in the property and debt. there was a letter from my sol saying she will no longer be reprsenting my and as cancelled my legal aid. i now have three weeks to find a new sol to sort all this out. i have cleared the debt,
i have the lump sum for my ex, but my now ex sol has told her sol that i cant meet the court order (bi**h) what will happen when i go to court again, i have kept my part of the order but it looks like my ex wont be able to sign the property over to me so does that mean she has broken the court order?
my ex has done next to nothing for nearly 2 years but our youngest has turned 18 (still in full time education) and she is now doing everything possible to ruin me, my lifestyle as had a dramatic decline whilst she is enjoying a better lifestyle than when we were together.
only thing i can think of is she is going to look a fool in court and waste evryones time with her actions. but i think i am going to be made to sell the house and be made homeless along with our son and pay her a larger lump sum as there is less debt attached to the house as i have cleared some of the debt.
sorry its long winded but i have had this crap for 2 years and i have had enough. i have done everythng i can, gone down every avenue whilst she has done nothing and paid nothing. she has changed her job for the forth time and is now earning so little that she only pays £5 CSA but can still enjoy holidays, nights out, cars , new expensive clothes (account is still linked to my e-mail so i know what she is buying)etc

Soulmanuk,
i can't answer your question because I don't have the legal insight it requires but I would say that if you could break the post up into separate short paragraphs for all the bits in it, it would make it easier to read and understand.
