Just looking for some advice..

Myself and my partner got divorce about 5 years ago.. we did it ourselves as we both agreed and was no property involved and we agreed amount between ourselves about kids that I would pay for my children until they finish education or start working...I took over all the debts etc .. and have full access rights .. i.e they come over and eat me out of house and home teenagers grrr

Anyway next year I am looking to buy a house with my girlfriend.. and just concerned that my ex partner might have a legal claim against the house as my girlfriend is putting up a large deposit..

Do I need to see a solicitor and go to court to get a some kind of financial settlement agree to?

In answer to your question, Yes, yes, yes!

You need to get a 'clean break' consent order drawn up dividing whatever common assets there were and agreeing that there can be no future claim on each others property, income and pensions.

You can never have a proper clean break where children are involved, as family courts have no juristriction over child maintenance. This is dealt with by the CSA.

The child maintenance can only be affected by a consent order for 13 months, after which it reverts to a private arrangement or to the CSA.

You already have your divorce so......all you really need to draw a line under the finances is to have a Consent Order drawn up.

Or you can get one done by a traditional solicitor - but they would probably charge a good deal more.

The main hurdle is that to get it for the above price you need your ex to be happy to stick to your original agreement and to be willing to have this drafted up into a consent order and ratified by a court.

If she (for whatever reason) decides she wants a new deal - the whole thing can become an expensive legal dispute.

So the real key is diplomacy and approaching your ex in the right way so that she is happy to have your previous 'informal' agreement made into a legally binding Consent Order.
