bill seperates from his wife in may from that seperation he has £10,000 in his bank account he then throws it all away on the horses, in june his form e arrives he has no money left they then go to court, the problem is the court can only consider money he has, not money he had and spent.

Hi
I posted on a similar subject. Only i have been spending on renovations and topping my wages up, from my savings. After scumbag moved in with ow, he left me to fend for myself, did a verbal split, now wants AR. I did not keep receipts or can even remember on what i spent my money on. So when i am asked on what i spent the money WHAT do i say. Didnt squirrel it away, but am going to be made like i did. He left me with a small low paid wage so i lived off my savings! But wisely invested some, what money i did make, it will go to HIM!

hi joy ....that sucks and i understand your anger....you must have pictures to prove your renovations ..???i have spent some money on getting the garden sorted should we need to sell ...i have pictures of before and after to prevent a situation such as yoyrs arising ..wise advice mum and dad...thanx...my husband however lives on base and has meals n rent taken out at source ..his outgoings are more than mine n i have the kids bills n mortgage to pay for. i wouldnt mind n i dont begrudge him a life.... i do however get cross when he tells the kids he has no cash to give them pocket money but he can spend 30quid a week in threshers and £90 in morrisons....the figures just dont add up

blimey dukey....im at a loss to know what to think.....what about cashing in assets n spending the money ....everything i have read classes this as very bad once the divorce process starts

Dukey .. am not sure you are 100% right on this.
I believe there have been cases where "dissipation" has been taken into account .. and the sum treated as though it still existed for the purposes of the share belonging to the party who squandered it.

it must mean something to the courts when a man has a healthy bank account and then from the moment a women says she is divorcing him he ends up as poor as a church mouse...i have his financial stuff from his form E disclosure....how can he earn 40k and be so poor that he cant take kids to macdonalds n yet he can spend money on new clothes and nights out...all luxuries i have had to give up so that the kids dont go with out....im with you hadenoughnow.....erratic spending or funds unaccounted for must be considered by courts....

I agrea the example is extreme, i was trying to explain that assets post seperation and pre form E are not one and the same.
The court are interested in assets and money from the piont of seperation but when the matter goes to court assets on form E are used, the million dollare question is how do you make a person share money they no longer have?
If money is wasted after form E is completed as i understand it the court has some "teeth".
I hope attilladahun db or fiona will pick up this thread and shed some much needed light on the matter.
i have been wrong before and i am sure i will get it wrong again, in advance sorry.
