after recieving my husbands form E i have discovered that hes been taking out large sums of cash (as much as £1000 in a week)as well as spending rather alot of money in various supermarkets(he lives on base and gets all accomadation and food stopped at source)...his outgoings as a single man are more now than when he lived at home n paid all the bills n mortgage...will he have to justify or prove where all this cash is going...???

I think so, I am in the very same situation and my solicitor is currrrently drawing up a questionnaire, regarding the amounts he has been spending. I have not yet seen the questionnaire, but he will have to answer her questions and if not we will go through the courts. However I suppose it depends on his answers as to whether she can prove he has been spending money negligently. If anyone else knows this please let us know. Does she then put the case that he has been spending negligently to his solicitor or does it go before a judge. She desperately wants to keep this out of the courts as it will cost too much.

Form E includes money and assets that exist at the time the form is completed so if money is being spend going missing after this piont then i assume the answer is yes, if you go as far as a final hearing he would have to show where these marrital assets have gone.

i am not concerned that hes been spending the cash (he was always very tight when it came to money) but that hes hiding it away..i thought that was a big divorce no no...any advice please....

I believe that solicitors and judges are interested in money and assets from the date of separation and not when the Form E completed. Yes Pyrategal squirrelling money away is a bif no no, your solicitor will be very concerned about it and will ask questions about i It is I believe then up to him to prove that he has spent it and then on what.

your quite right form E is full and frank financial disclosure, so hideing money or misleading the court will land him in hot water later on, if you do go to court your counsel can question him as to where this money has gone, to find out if he really has spent it on every day liveing or he is as you say hideing it.

i feel so let down by him...i disclosed everything...from money i got for my birthday to a small sum of cash i earnt thro doing some extra work....the only ones to suffer are his children when he tells them he has no money to take them out...can any body really spend £1000 a week on every day living unless they are the beckhams
