savings since split? 4 Months ago
|
|
After first mediation session I have been asked to provide copies of bank statements as part of the financial disclosure.
We have been separated for 5 months and in that period I have saved some money. Some of which will be used for solicitors fees and some of which is for things like car insurance and road tax, also for my childrens birthdays and christmas presents etc.
Will my ex have a claim on these savings?
I really need this money for future expenditure and if he is going to claim some of it I wont be able to afford to pay my solicitor or insure my car Help!

Lilyrose,
The savings are part of the joint pot. But don't forget that he too has to fess up to anything he has stashed away anywhere.
From what I recall of your situation, he stayed in the FMH and so has to buy you out of the marital home. In the overall scheme of things, it shouldn't be a problem. You are not likely to give him that cash unless he has paid up what he owes to you.
The mediator is asking for the statements, not the cash.

Thanks Mike
I dont think I'll hold my breath for him admiting to any savings, he told the mediator he earned £34k but the mediator spotted his P60 and oh dear what a surprise showed he earnt £54k last year! So all in all a bit of a devious person
Think I need to get rid of some of it. I'll pay my solicitor what I owe her and might even take a holiday, after all he managed a week in Spain last month despite pleading poverty.
Its just annoying that I'm likely to be penalised for trying to be sensible with my money.

Hi
I think you could give you solicitor funds for future legal bills too.
Infact you could probably give it all to them (with instruction not to draw on it without your permission or something ?)

Hi Mike
Do savings since Decree Absolute also get included in the pot? My DA was given a couple of months ago but my FDR is in 6 weeks?
Thanks
M.
