[img] I gained a clean break divoce in 2001, kept the house and mortgage he never paid maintenance for myself or children, h walked away with £30,000 I had known nothing of, his naval pension and he cashed in the endowment policies that covered the said mortage. Then this month i receive a letter from him saying he is taking me to court to gain a share of the equity in my home. Has anyone out there known of such a thing happening?

yes this is whats happeing to me X is coming back for second bite of cherry Im in court next month. best I can help you with is that when the first judge made his comments it was basicly dream on... her side is now taking the case further so it drags on.....

I can't understand if it was a clean break how can they come back now? Surely clean break means just that? If they can come after the house now can you go after the naval pension?

An order can be appealed out of time ( Even Clean Break ) but this has to meet certain conditions and most get quashed at the first hurdle. You need to post more details really but on the face of your first post it would seem your exh is the one in the wrong for non disclosure of his naval pension and 30k if i read correctly.

Thanks. Think this site is too depressing. I wasn't happy at the time he got so much! All I can say is there is no such thing as British justice. What is the point of a clean break if this can happen.Good luck

I thought a clean break was what it said it was. Can only say there is no such thing as justice. I was forced to accept the judges decission at the time although I felt entitled to some of the naval pension as I was married for 9 of the 16 years he was in. Thanks.

It was all disclosed. That is why i got to keep the house and mortage. I had children aged 10, 13,15 and one over18 at that time. We had been living on income support since his departure before the birth of the youngest. I had gone back to college and was nearly finished a nursing course that got me and the children off income support. He actually paid the mortgage for 18 months before separating. I have lived in my family home for 19 years.
