yes i know its fair % but what im saying is do i have to pay the value that its worth now or when i sell the house which could be in 14 years time when my son is 18 do they take what the house is worth then

Hi Hidden. Why is it you want to hang on to the money until your child is 18? Is it the interest you are hoping to profit by? Why not carve up the equity (to an agreed amount) and let him have his percentage. Surely he needs this money to get somewhere to live? Are you doing this to punish him or as some garentee that he will pay you CM and or SM? Chris.

well if you knew what the b.....d has done to us (unreasonable behaviour is a understatement) then yes i wish i could punish him.all it is ive been told that i might not have to give him anything till my youngest is 18 and all i want to know is do they take the value of the house when im near the end of my divorce or when i sell it in the future

I see. U didnt say. Well I think what normaly happens is they put a charge on the property and he gets the money when you sell it. He will get a percentage of its market value at the time of sale. A charge is something that gets registered with the land registry. This has to be done with a court order and will require some conveyancing.
Pity there is not a "total bastard" charge on a divorce petition huh? Chris.

The fairest settlement is a percentage of the future sale value for example:-
House today valued @ £250K split 50/50, each get £125k less all costs
In 7 years might be worth £500k, each get £250k less all costs
In 7 years might be worth £200k, each get £100k less all costs
Courts will not take into account unreasonable behavior in divorce proceedings as a detriment to either party when settling finances, unless it was so bad as not take it into account.
So bad has to be pretty severe, for example one spouse beating the other to a 'pulp' and rendering them unemployable is pretty bad
Screwing around with all and sundry is not
