Hi I have a friend who is thinking of getting a £40 Separation agreement of the internet.
I have advised her not to as her situation is complicated.

In the agreement she is hoping for him to agree the following.

1. The agreement will mark the start of 2 or 5 year separation.
Bothe parties are living in the joint house till it is sold.

2 Sale of the house will pay of debts of £30K
Only if it sells at the asking price.

3 That any money left over is split 50/50
He has the impression that he is getting £50K what ever the house sale is.

4 He has no claim on possible inheritance.

5 she keeps the pets.


6 The kids are living at home but over 20years old.

Any advice on this and also where could I find a template of a separation agreement.

Do a search on here under Separation Agreement and this will give you a flavour of the difficulties than can be encountered.

If -

He has the impression that he is getting £50K what ever the house sale is.

then it sounds as if he won't be agreeable enough to abide by the agreement in which case it won't be worth the paper it's written on.

I couldn't recomend them - for anyone.

If she is insistent, then for it to be given any weight in court she must be able to prove (amongst other things) that she has taken legal advice - so pack her off to a good solicitor asap.
