over the weekend I found out that we have £150000 more business loan than in January ( this has already found a home ) We both have to sign bank agreement but I never consented to this loan and never signed any agreement ,unfortunatly my signature is easy to copy. I have wriiten to my solicitor asking her to request proof from x2b that I consented to the said loan. If I can prove that he has forged my signature is the solicitor bound by law to report him? should I leave the solicitor out of it and deal with the situation myself? Even with his appalling behaviour I do not wish to see him in prison,he is still the father of my children!!! The matter can be remedied by negotiation . I have already written to my solicitor but have not posted it yet,I usually hand deliveredmy letters at night.So waiting for some advices urgently. thanks

Hi Marriaa My stbx set up a direct debit against my account (which is fraud). However both the bank and sol. said I needed to report it to the police and get a crime number. It was only for a small amount but without a crime number nobody took it forward. I didn't report it as life is hard enough anyway!!!! Good luck

Hi there
Send your letter to the solicitor and ask her to ask him how the loan was taken.
If he agrees to take responsbility for it, you can leave it there if you want to. If you want to take it further, you will then have to contact the lender.

[img] What a shock reading this!! It has happened to me. I have been to bank twice, police once who wont act without evidence. My x is forging my signature on business account which is causing a big problem as business is on floor anyway. I have now written to higher authority at bank as I feel I am not being taken seriously. I have requested copies of all cheques written in last year so I have evidence to take to police. My x has moved new women into our fmh, ignored an interim court order and generally does not recoginse any authority at all. I am fighting this without solicitor as I cant pay one. I will not let it go and neither should you!

Im afriad for me its give him the big shock to his system, hes probably expecting you to do nothing and think of how the kids may respond to his actions. It is fraud no matter how its done and the consiquences should be paid for, I didnt bat an eye when my x and her bf were put in the cells for while. to me they should of threw away the key, I have never had any recompense for their actions and had to put up with paying out a few thousand to do the repairs. also you have to remember that if he fails to pay this loan they WILL come to you for the payment and expect it, even to the point of taking your posessions to clear the debt.... as was said .get your sols to write to the firm telling them that you have not signed or agreed to this loan.

Maria If indeed he has forged your signature, and you will need to get concrete evidence for this, it constitutes a crime. He may be your xtb, but, he should not have done it. I personally would care less about what would be in store for him and think more of you and the children. If this is not proven, that your signature has bee forged, then you and the children will be paying off that debt for years. there is no dampening this down to anything but a crime. He should have thought more about it and the consequences before he did it. Personally I could not live with it, but if you feel that you wish to let him destroy your future by putting you in debt, you might regret it at a later date. I hope that this gets sorted out quickly, it is one hell of a lot of money to be merciful about. zara x
