Hi everybody,
I hope you could help me with this one.
Husband went bankrupt in feb last year.Lived under the same roof, with him paying next to nothing for home/children for years. Filed for divorce on the grounds of UB. To put the nail in the coffin he started to have an affair.He is seeing his new woman agin this weekend. I told him I do not want him back any more in FH.We are joint owners. He says he can come and go as he pleases and I cant do nothing as he is still the owner of this house. But according to trustees his share is taken by them, so technically he is not an owner any more. If he comes back and I refuse to let him in and then he decides to break the door down (belive me he would, he's got extremly bad temper)do I call the police and tell he has got no rights to be in FH. Please help

Eagle, Welcome to Wikivorce. Sorry to hear of your troubles. You could apply for an Occupation Order, which basically stops him from coming into the house at all, whether his name is on the deeds or not. You would need to show just cause to get such an order and a diary of events showing dates and times of incidents is an ideal way of achieving this. It is helpful to report the incidents were reported to the domestic violence unit of your local police, so there is an official record. Remember, domestic violence is not necessarily physical. If his behaviour leaves you genuinely in fear for your own or family's safety, then it is unacceptable. Hope it helps Mike

Hi Mike, Thank you very much for your help. RE Occupation Order can I do it myself or I need to involve the solicitor and how long does this take.I filed for divorce and the papers have just ben sent off to the court. I am also in a process of bying his share from the trustee.I am emotionally and physically exchausted 2 kids to look after and one year of university to go. But advise if you can please on occupation order before I start yet another burden to carry on my shoulder.

I think you can get an occupation order very quickly if you know what you are doing. It might well be worth using a solicitor so that it gets done properly and goes through relatively easily.
