Does approved Consent Order start now? 3 Months, 1 Week ago
|
|
Our Consent Order has gone before the judge and been approved. (only took 5 days from me returning it signed).
Is it with imediate effect that we have to follow it? Like I put my maintenance up etc?
Or does the Consent Order and what we have agreed come into place once our decree absolut is through?

Hi Robert,
If this is wrong, someone is certain to correct me, but I do think that you need to have the Absolute in place before the consent order can be implemented.

Hi Robert,
What Redoctober has written in plain English I will translate into legalese:
A Consent Order is binding from the date of the order and comes into force on the date of Decree Absolue being granted.
I am however a bit surprised that you do not have a date stated from which the maintenance is to start. What is there legally to stop you starting it in 2020?
If you have a Consent Order then you both must have surely agreed something. Why not implement your agreement and consign the Consent Order to a drawer from which it may be pulled out and referred to should a disagreement arise?

Ok. I am now more confused.
I have no decree absolute. Am I supposed to? I just have a copy of the consent order sent by the courts which was approved by Judge "So and so" on a certain date.
We did both agree to the consent order, I just wonder when it comes into force???
Is the decree absolute supposed to happen at the same time? I understand Red October, but confused a little by Young Again as it seems to say the opposite yet the same.
"binding on the date of the order" "comes into force on date of absolute"
Does this mean, it is now legal and agreed, but we await the absolute before acting on the instructions of the order?
Sorry to be so daft.

Hi Robert,
Sorry to confuse you but yes you got it right! The Consent Order is 'binding', that means it is agreed and issued by the Court and a Legal Document, just ready and waiting to leap into effect.
The Consent Order comes into effect on the day your Decree Absolute is granted.
The Decree Absolute won't just 'happen' - someone needs to apply for it.
Good luck!
