I have received the petition and statement of arrangements for children, back from the courts and so has STBX, but she has a form called Acknowledgement of services, there is one question on that no (6) "In the event od decree nisi being granted on basis of 2 years seperation do you intend to apply to the courts for it to consider your financial position as it will be after the divorce."
What does STBX answer there since we have both agreed that we shall create a draft document for the finance split and get it leagalised by solicitors. I have not drafted this yet and she has managed to get Legal aid, so she may go to the solicitors with this letter what does she tell them to write there.

I'm rather puzzled - do you mean 5 years' separation rather than two ?
Two years implies consent, five years does not need consent in 99.9% of cases but there is a fall back provision for a divorce to be refused for exceptional hardship.
This hardly seems necessary for two years apart ; if you don't want a divorce, surely you don't consent ????

STBX went to solicitors and question (6) was answered YES, which I was led to believe that if STBX requires finacial help from me during the process she can get from me. Also I have noticed that this question on Acknolodgenment of services form D10(1) is different, compared to the latest form that recived i.e. form D10(3).

I am all for the idea of your trying to settle the finances by negotiation. I wish more would do the same.
But surely your x2b is just reserving the right to make a claim if negotiations fail ?

I suppose she is, I am just waiting to complete the process till I get as far as Decree NISI being granted, then i am led to believe is the time to start the finances, or can this be done after decree absoulte. Are you aware of any sample forms that can be used to create a mutual finacial agreement without having to go through the process of the nightmare Form E?
