Consent order challenged by judge? 3 Months, 1 Week ago
|
|
We have done divorce ourselves and my SBX has signed the Consent order and statement for information for consent order - he has also had his money, and spent it! These papers have been lodged in court yesterday. We are now falling out over contact for our child, and I think the SBX may cause trouble if he can. Has anyone had to go to court for the judge to go through he Consent Order before he agrees it. And if so what happens is SBX puts spoke in and changes his mind, just to cause trouble, cos he want the child more?

Hi Chris,
If you applied with a form D8a at the time of the application for nisi you should have received a form from the court saying everything is OK - I forget the form reference.
This form needs to be submitted with the applciation for absolute - it has nothing to do with ancillary relief.
If a D8a wasn't submitted and you can't agree contact with your stbx, then I think you need form C1 to apply to the court for it to pronounce on contact arrangements.
A word of caution about C1, for God's sake try and agree something between the two of you - it is better by far for all concerned.
Good luck

My point is, that I am trying to keep money and child separate. I dont think SBX will, he will cause trouble moneywise, if he doesnt get what he want contactwise. He is an alcoholic who has moved possible wife 4 in already, and want our 2 year old to stay over, at least twice if not four times a week!
