Can Absolute be 'postponed' until finances settled 4 Months, 1 Week ago
|
|
Hi all, H can apply for the Absolute within the next 2 weeks. My solicitor has written to his to request that H does not apply for Absolute until the finances are settled, but he's not responded yet. In this situation, can the courts be asked to not grant the Absolute until the finances are settled? I guess this happens quite a lot so there must be something to protect those of us that are entitled to a settlement? Many thanks.

Hi Carnation,
Yes, your solicitor should lodge a letter at the court saying that you object against the grant of absolute until the ancillary relief proceedings have been concluded as it would compromise your financial position etc.

You do have to give reasons, however, as to how it would compromise your financial position.
