We have been 'ordered' to agree a valuation on our house (former matrimonial home) where I still live with our daughter.... and if we don't 'agree' by 25th Feb, the court will appoint a valuer which we will pay for...
How does one 'agree'?..... As we are not even civil with each other, and haven't spoken in months, I am wondering how we shall go about this...
I have already had a valuation done... my STBX refused his permission to have a valuation done, when approached by the estate agent...
Any advice would be appreciated

Is the valuation that you have from a local estate agent with good knowledge of your area, and if so why does the court not recognise it.

Your s2bx can refuse to accept any valuation, but at some point he will be forced into one, and if that means by court order, it is only mounting up totally unnecessary additional costs.

To give you an example, my s2bx says that the FMH is worth £170,000 (Top of her head) but I believe it should be nearer £225,000 a big difference, so it is up to me to have a proper valuation although not really necessary as our agreement is for gross saleable value but in percentage terms.

Well, if it were me I would send him an e asking him whether he agrees your valuation and if not inviting him to get a valuation of his own. Perhaps then you could suggest the mid point as the agreed valuation?

If he doesn't agree or respond then you will just have to wait till 25th and pay half the dcost of the valuation (£200-£300?)

As part of my Form E... I was asked to obtain a valuation on our house... I asked Halifax... but, as the house is in my STBX's sole name, they said they needed his permission... they called him, and he refused to give his permission.
So....I went to another leading estate agent in the area...and they came out and valued the house...
Now, at our 'First Appointment' on Monday... my STBX said that this wasn't 'his' valuation...
Therefore, we now have the situation we are in....
He knows the valuation is accurate... but, it now seems we have to 'agree'... and with no communication between us.. it is somewhat difficult...
If... for example... he decides which estate agent he wants to use, am I now in the position that I have no option but to 'agree' to it?

Just let him get the valuation, unless its outrageous you wont have a problem.

i'm going though a similar thing at medition my s2bx did not like the valuation i got so the mediator said i should get 2 or 3 local estate agents to value it to show that their were all around the same figure to stop her dismissal of it with the understanding there may a couple of grand difference between them and we would have to settle on a middle figure. as it turned out the dirrence was just £50 and she had no option but to agree, maybe if you provide 2 or 3 valuations to the court their may insist that your h has to agree to that amount.

my experience was a difference of £50k between valuations. But then, its an unusual house and that perhaps makes it harder to value.
