What if he doesn't exchange Form E 3 Months ago
|
|
I intend to make all the deadlines for the first court hearing on ancillary relief in a few weeks time and nearly have all my paperwork complete. If my ex doesn't make the exchange of Form E or the court case, what happens next?
Do we have to start again with yet another cheque or do the court just reschedule? I'm self repping as sols just too expensive. I can see no reason for him not to play by the rules - but no reason for him to change the habit of a lifetime. He's going to lie through his teeth anyhow, I ask myself why on earth am I bothering.

a copy of your E Form can be filed with the court and you can arrange with his solicitor to exchange them at his offices so you both get each others at the same time.# the court dont mind if it is delayed by a few days or a week so just ring his solicitors to arrange the exchange kind regards dawn

Neither of us have sols. Although I'm arranging - sorry - trying to arrange for the exchange to take place through the sols I used to use. Basically using them as a postoffice. (injunctions against him and suchlike).
But say for example he refuses to make the deadline, which would be par for the course, and he fails to make the court appearence - then what? Do I have to start all over again and reapply for another court hearing or does the court pick up the reigns and take over the procedure?

Hi, you can lodge yours with the court and he wont get a copy until you have proof he has lodged his i think is the best way forward if he doesnt lodge his then yes you will have to apply to the court for a penal notice that will mean they will make another order and he will have to pay costs in the matter, it will also go on his notes with the court that this has been done. hope this helps kind regards dawn
