had FDR end September. Was told that we would have to have full day for FH. Great as there is no money! x wants a lump sum or spousal maintenance that is greater than the total equity in the house.
am waiting for date - have been told there is another case still wating to be listed and then it will be our tuen to get a date. Does anyone know how long this it is likely to be before I hear?

Hello
It depends entirely on how busy the court is it can take months.
It is entirely piontless to go to the expense of a final hearing if there are little or no assets the cost of the hearing will reduce what assets exist considerably.

Hi taylr14,
That's odd. Usually the court gives a date at the time of the FDR and then confirms it in the directions issued adter the hearing which take a week or two.
Have you tried telephoning the court or failing that, writing or visiting them to find out what is going on?
A day's hearing should be within 4 - 6 months of the FDR.

I know there is no point - but I can't give him what I don't have and he won't settle! He has been told by the DJ at the FDH that he won't be awarded what he is asking for as you can't have a capital award if there is no capital and that the DJ couldn't think of any DJ that would award SM to a mman who isn't working or maintaining his children against a woman who is working full time and is sole provider for herself and their children.
I can't settle if he won't.
Have rung the court (as has my solicitor)hence the question.

have contacted court and been told earliest date will be march next year. So that will be 6 months from FDR to FH. fingers crossed he gets legal aid and a solicitor in that time!
