Hi DL asked me to post this info as I had a query in Legal Surgery tonight.
Ages: Him 41 Me:32
Kids: 2(Boy 5, girl 6) Nights with each parent: 2 nights per month with hime, rest with me.
Marriage: 8.5 years on separation, 2 years previous cohab.
Incomes: Him:35k Me: 10(Tax credit/maintenance/child benefit)No job yet.
Outgoings:He has nothing left after paying his rent/mortgage on FMH where I and children live. I have nothing left after paying all other bills.
Assets: FMH approx 280k?? Holiday home 81k?? Pension him 24k although now worthless he says He is expecting personal injury claim anything from 250k upwards in next few years
Liabilites 139k mortgage plus 1k student support centre loan for kids.

Thanks for posting this.
As discussed the PI award is likely to be important, so at the appropriate time you will need more info, particularly as to whether liability is accepte
PI awards are split into 2. There are general damages, and special damages.
General damages are for pain, suffering and loss of amenity. You will not get a share of these, however, these are by far the minor aspect of the award.
The major aspect is the special damages, which is for things such as loss of earnings. Due to the earning difference between you, this is where the importance of the award lies.
