The consent order went before the judge 3 weeks ago but was not granted. The judge queried the £ split in any profit after property is sold at auction & wanted CETVs for pensions - Even though we are not pursuing. I have sent CETVs & we both drafted and signed a letter explaining why property profit is slit the way it is. Will this now just get re-presented and accepted?

Mezzie - could I ask whether the solicitor who drew up the Consent Order reassured you that the judge would accept it without pension CETVs? Was the property value quoted as a percentage of the sold price or a specified amount of cash?

It's not at all uncommon for a judge to query specific information and once he/she is satisfied that both parties understand the agreement grant the order. Rarely are consent orders not approved.

Hi Maggie. Consent order was drafted & worded that pensions were not being pursued and stood dismissed. I assume judge is just checking the pension amounts are actually known by each other. The profit - IF ANY - Is after the property is sold at auction to clear existing mortgage. The split is to reflect the fact he is keeping his sole debts & might be able to clear them with a bigger %. Leaving us both to begin from scratch.
