Can anyone answer me?? At FDR the Judge told my xtb that ultimately the sum he receives from me will be whatever I can afford to give him and if that is a nominal payment then so be it. I have now collected evidence from lenders on the sum I can borrow. However, to take on this sum of money it is going to cost me everything I have, and while my 11 year old daughter and I have a very simple and modest lifestyle it would mean I probably will not be able to afford, well, anything! My xtb is adament he will not sign the house to me and says I am entitled to 5% of his significant pension due to a marriage of 9 years. The Judge at FDR said our marriage of 9 years and 15 year total relationship would be classed as long term. He adjourned FDR and told us to come to a settlement but if I give him even a nominal amount, less than £10K, it is still 3 times less than what he demands.........(which the Judge said was unacceptable), considering it was more than 50% of the net equity and he has a considerable pension, £83K more than me to be precise. I will never be able to afford to put into a pension. He also stated that the costs involved by going to a full hearing would amount to more than xtb has initially taken me to court for. The net equity is approx £60K at present.
I think what I am asking is as the Judge said all this at FDR and has adjourned, will the same Judge still think the same and if it does go to a full hearing, is the new Judge likely to rule much different.

It is impossible to say, YOu will have a different judge, What I can tell you is that in my case I offered the upper end of that the judge at FDR thought was fair. That is EXACTLY what was imposed at Final hearing - although the reasoning was different, the result was the same.
It would be interesting to hear from other wikipeeps what the difference was between FDR and FH.

We settled at FDR. Neither party felt satisfied. My arrogant ex could not believe that judge accepted my argument rather than his. I felt I had to pay too much but as we were not that far apart my solicitor advised me not to go final hearing as costs would eat up the pot. As it was ex ended up accepting £1k more than my last offer. When you factor in both our sols fees for the day - would have cost less not to go to court. If you are fighting big money case then Ok take it all the way if not - compromise
