Wonder if anyone can advise? My x and I divorced 7 years ago and have shared the care of our two boys 50/50 since then. The 11 yr old is quite happy with this still, but the 14 yr old prefers to be with me. I guess for most 14 yr olds this would be voiced by him, and parents would begin to follow their request at this age. However, as he has Down Syndrome his father argues that he is not mature enough to understand or to make his own choice. I disagree with him and want to change the arrangements. I'm still happy for lots of contact but he wants to stay with me on school nights. Do I need to get a solicitor and go to court (we managed to agree without all of this originally)? Thanks for any advice.

Hi there
I am sorry to hear you cant agree this so far. As you have shared care you have 2 options. Apply to court for residence so you can change the arrangements, or simply tell dad what is happening, and if he doesnt like it let him apply.
However, if you can thrash it out between you that would be the best solution, even if it means you have to write to dad initially to inform him why you consider the arrangements should change.

Is it as simple as that? I just write and tell him what's happening. Can it then happen - what when he writes back and says it isn't? I am certain that it's what my boy wants but I don't want to argue in front of him.
