Please see my situation in brief below and advise if you know the answer. I would be very grateful??

I am divorced and remarried.
I went through court and X wife got everything
I remarried
I got my 2 children (10 and 13) back as X wife became unstable and children were at risk and court informed of residency change
I now have my own 2 children and my new wife and her child of 14
My X wife pays no maintenance
She claims she has no job and can not fund maintenance
Her partner is now very well off and runs a succesful business - they have 3 children between them who live with them.
Can I claim maintenance either through a court, or CSA from her as she is now in a relationship and living with this man for the last 2 years?
He would probably claim he does not live with her and I think he has his business registered elsewhere. I also think he is clever enough not to have any bills in his name and my X pays all bills and is also claiming from the state as a single parent.

Please help me?

If she has no income, then I believe but I may be wrong, that the CSA cannot assess any maintenance from her to you.

Her partners income is not taken into account, although I think there is something you can do if she has remarried and he has assest over £65k.

As I said I am not certain on this as Ive not read-up on it recently, suggest contacting CSA to find out?

I think the CSA dont want to help if I went through a court for the divorce.
He has 2 Audis, 3 racing prepared motorbikes, but their home is paid for from the house which I completely had to sign to her.

That is correct littleblue CSA 2 does not include NRPP income into the assesment just the NRP's net income.

If the NRP has assests ot property worth more than £65,000.Where property is concerned , this is the value after any outstanding mortgage which is still owed and has been taken off.Assests do not include the home that the NRP is living in or assests they use for their business.

Oh, so as far as I am concerned, I am stuffed! Its so unfair. They are jointly really well off, and me and my wife are struggling. Surely if she is, in the eyes of the law, cohabiting with this man and they have 3 kids together, there surely must be a joint responsibility for her offspring?

Well basil you'll like this rule with the CSA , children that live with the NRP come first so many times the NRP new partners kids come before the NRP bio kids , so in the case of my ex and her she has 3 kids 3 different fathers say they all pay £200 p/m thats £600, the first 25% of his net income is taken off his net income for the relevant other children so add that up, 4 blokes in total supporting 3 kids and then the likes of me gets well it was peanuts something like £170 p/m to support 2 kids .nice rule huh.

Dont you just hate it. Its the kids that look up and wonder what is going on when we have to say we cant afford this and that, but their step brothers just got £1000 spent on a 4th birthday party!!!!!!!!!
My poor wife is so mad with it all as she justs sees the ex laughing at us and it affects me and her and the 3 kids we have.
