Quick run down of my current situation:

Currently going through a divorce at nisi stage and solicitors discussing child custody etc etc. Still living in the same house with her and my 3 fab kids. Currently paying 70% of all household bills, mortgage/utilities etc. Food shopping split 50/50. Still have 7 nights a week access/contact shared care of all 3 kids, still very much involved in all their activities.

She now decided to get CSA involved and they have awarded her £584.00 per month. This has been ­base­d on no deductions for my contact.

I suppose my question is that given there is no NRP or parent confirmed with care how can those lovely people at the CSA become involved in the first place.

I am not physically able to pay this award along with all my costs I am commited to for the home.

I think you need to get back on the phone to them you are not a NRP at present , CSA should not of been involved yet.If your ex does not claim income suppot or job seekers allownece you do not have to use the CSA as you can come to your own private agreement.Word of warning though until this mess is cleared up with the CSA you are going to be getting arrears.So call them tomorrow surely you have the same contact address as she does.

BTW did you send the CSA your wage slips for them to come up with that calculation , or is this guess work on their behalf.

I was told by the CSA that until my husband left the marital home I was not en­title­d to any maintenance and indeed when he did leave as he is still paying the mortgage, the payments were still below the normal payment levels, so no way is that correct unless you're earning in excess of 50K and then not until you have left. I have to say that in the several conversations with the CSA they are not "on the woman's side" at all and definitely take your own circumstances into account. They will speak to you as well to get your side of the story and income details. Don't worry yet.

They have written to work and obtained all salary details for the past 12 months from HR

Thanks for your comments folks. Further update, have been informed today by the CSA (after demanding to speak to a manager) that they have reduced my assessment by 2/7ths. They have reached this decision on the basis she says I have no custody etc I say I have full, awarded her 3 and a half days and then deducted a further day and a half because they need to take her account into the equation (if that makes no sense sorry)

Anyway have faxed them further proof of shared access for all school holidays as confirmed by both her solicitor and mine, full bank statement in my name to prove all bills are paid and have basically said they will not review furthr and that the decision stands at 2/7ths discount.

I am now forced to go through official appeal which could take months and in the meantime I have to start paying and paying off 10 weeks of arrears.

Dont have the money to pay both CSA and household bills - so will now have to cancel some of the utility bills and stop paying my half share of the food bill to pay the CSA - this makes me look like the bad guy to my kids

Sorry to ramble but feel like screaming at the injustice of it all

Your correct there about appeals i put in for an appeal early Nov, had appeal 11th june.

There rules are regarding reduction ­base­d on number of nights per yr the NRP has over night care.

52 to 103 1/7th
104 to 155 2/7th
156 to 174 3/7th
175 or more Half and then reduce it again by a further £7 a week.

I know the CSA are suppse to be getting tougher but surely they should of contacted you first and not your work , did you have any form of contact from them as it states calculation is calculted on the date they make contact with the NRP.
