Hello everybody, apologies if this is written badly, but I have only just registered this morning, and just need some advice. My husband is currently divorcing me for unreasonable behaviour, this is an amicable divorce, and we are trying to keep away from solicitors as much as possible. We have two children who will live with me. My divorce settlement will be half the house, namely about 40K.
My question is this, my husband wants to give me 20k, then each of our children 20k for their future,to be held by their Gran as she sees fit, for cars, schooling etc. as he doesnt think, given both of our incomes, that we will be able to give them anything later on in life! I am quite happy with this, I have no debts and can privately rent whilst I concentrate on getting a job with more hours. What I am worried about is, if I ever do need any help, for example if I lose my job etc, have I automatically lost any en­title­ment to benefits because my children have money in trust? Sorry this is so long winded!!

Cuddle bunny , a case of swings and round abouts not much 20K you may get more in benefits .The way things are going I would say keep the house for the children move out and move to rented , let him keep the house do a will leave this to you and the children, Do not get divorce it is only a expensive piece of paper . Surely the recession now the house prices will drop.

I realise you don't want too much involvement from solicitors but from what you say I think you would benefit from speaking with one - even if only initially to inform you of what your rights are. For instance, if you are to be the Parent With Care of the children you would likely get more than 50% of the house under normal circumstances.
