Hi my name is Howard and i am 65 yrs. old, and i am at the end of my wits regards my divorce.I started proceedings for my divorce March 2008 with a lawyer. I was awarded legal aid. I was awarded the Petition and i was to have a hearing at county court on Feb 2009. But unfortunately i had a heart attack and had to have surgery. Therefore i could not attend the hearing, so then ofcourse the hearing was ajourned. My Lawyer did receive all legal aid for this issue. I later received a letter from my Lawyer telling me that the funds had run out and that he could not attend the court. Anyhow, in December 2009 i wrote to the Court myself and asked to reopen my case. Fine, they opened my case again and i attended a hearing last January27. 2010.I completed the form E160 so i did not have to pay the £300 fee. I am now at the stage of waiting for the D10 form [Acknoledgement] to be returned. I f she does not return the form this time, do you think i can still carry on, as she did, return the D10 form on the first Petition? By the way my wife is a Philippino living there in the Philippines so they gave her 30 days, to return the D10 Form. We have been separated 7 years now.. and the divorce is on that grounds. The court now sends me the correspondece as im doing all myself. My next step is,if she dont reply, i have to apply for : ex-parte on affidavit for the District Judge to concider whether the directions should be given.This costs £40. Do you think i coul get more Legal Aid ? Im not so happy with my past Lawyer. I spoke to him once since and would like to know how im progressing. He told me that i have to stay married and make a will out. Iam now doing everything on my own but it is a strain on me as i had heart surgery Angioplasty.I am now 65 years old and maybe Legal Aid can still help me as i am on pension. Anyway i dont think there will be much more to pay and i can manage. Well who ever you are i hope you understand my words and i look forward to hearing from you. Thank you... Howard Winton
