Spoke to my solicitor first thing this morning, which is an accomplishment on its own. Told her of the events of the christmas and new year period. I did not even have to use gentle persuation to get her to suggest that the application to the court was made for the injunction. She said that we would ask the court for a no notice order, which means he will be served with the injunction after the court has agreed it, he will then get a chance to answer it but the injunction will be in place as soon as he has been served. I needed to email her a statement of the abuse from day 1 to present time. As many of you know, that was no mean feat as the abuse has been ongoing for some near 6 months; that is only since he left of course. That has taken me the majority of the day and I feel I have neglected the children some what today; but I have to tell myself this is all for their benefit as well as my own.
After telling her the details of his contact sessions over the period; without hesitation, she said that we now have no choice but to apply for funding and then apply to the courts for a "Defined Contact Order".
I don't know what tonic my solicitor had over Christmas but it has done her wonders. Like I say; my life is full of negatives at the moment, the abuse I am still suffering and the trouble with contact sessions and the fact that my X2B has now withdrawn all physical contact from the children. But on the positive side of things; I will now, fingers crossed get the injunction to keep him away and stop the abuse and secondly; he will now only be able to see the children under supervision until a "Defined Contact Order" is in place. Will he go for that? Who knows, but I doubt it.
It pains me to think that the children will not be able to see their dad; but after the contact session they had on Sunday I cannot put the children through another day like that.
This year, 2008, I am going to see the good in every situation; well that is the theory, anyway!

IfI, that sounds so much more positive than the run of things you have had recently. Your solicitor sounds really geared up to get this in place and it sounds like it may give you some well-deserved protection. I'm sure there may be the odd hitch along the route but it we're all pulling for you. |
