Reform of Divorce Laws may be needed in my opinion!Posted by moonstar04 in Untagged |
How can a couple who have been married for 17 years have 2 fabulous children, converse by email only, yet live in the same house??
Today I stooped to his level when I sent him a mail asking if we could draw up the split of marital material assets, sofa's, bed's etc etc. Needless to say I am still awaiting a reply.
Sometimes I just want all the pain to go away crawl into a hole and forget it all. Yesterday morning I woke up mid dream and had to realise that yes it was another day and for a split second I had actually forgotten why I had lain awake most of the night unable to sleep with all the stress and strain of the divorce. Then wham it all came crashing down on my shoulders again that egg shells feeling.
Why does a UK divorce take so long and be allowed to be so drawn out when over in the States you can get divorced in half a day and move on still wearing the same pair of pants you put on that morning!! Is it time for a reform in our country with regards to divorce timescales.
I do not believe it actually takes as long as it does, maybe more complex defended cases but the average divorce could be sorted in weeks as opposed to months and years. All the heartache and pennies spent on legal fees could be saved and used for building a new start for families and children.
Divorce is a paper trail of rubber stamps till it gets to financials so why it takes a minimum of 12 weeks beats me it could be 12 days in an uncontested case. Government reform should not allow the average family to rack up so much in legal fees just to end a marriage when in most cases every penny counts in rebuilding broken hearts.

Hear hear Moonstar! Me and STBX habve taken to writing notes to each other. She doesn't 'do' e-mail, or I might be with you on that too! As you imply - How the hell does it degenerate to this? Believe it or not Moonstar the divorce law HAS been reformed. It took longer beforehand because of the different way the financial matters where reported. The reason it takes so long is because the Law doesn't would rather not impose anything on the parties. I think this is because the Court system knows it can't enforce it. Who is going to send a mother of young children to prison? It won't happen unless it's for something like attempted murder. So the process is dragged out for ages in the hope thatl both parties get so fed up they acknowledge the Court and lawyers as the common enemy and unite to settle the arrangements for the children and the financial split themselves. Unfortunately, every now and then there'e a spouse or a pair of souls who just cannot agree on what day it is never mind anything else. If this fact is brought to the fore, I believe that the whole process could be rushed through within about 30 months. Hmmmm.... |
