I am in the process of divorce husband committed adultery and within a few weeks had moved into his partners home, which was sold and then purchased a much bigger one. I am living with my mother and have been since the fmh was sold May 2006. Proceeds are lying in his sols bank account(they were the conveyancers.
Have had FA the FDR and finally a hearing. We are arguing that my housing needs are not met, at this point I must mention that my soon to be ex and his partner both work for the LA housing dept. At the final hearing (which turned into a further FDR as the judge did not have time to hear it) Terms were agreed and my barrister was writing out the order when they said they wanted an adjournment as they said they had a document from the LA. My barrister said that he wanted it noted that we would ask for costs. The document produce to my sol was from the LA basically saying that I was living with my mother naming her and that she was the tenant and mentioning my brother but basically said that when my mother died that the LA would find me somewhere to live!! They also know that i have been awarded priority status on health and medical grounds. Basically they are saying that my housing needs are met. Does anyone know how a judge would view this. They also breached data protection by obtaining this information and my mother had recently requested copies of this.
Final hearing!! in November, would appreciate comments on how a judge may view this especially as the reason for the adjournment was through a document which should not have been obtained.
Also if I was awarded a LA home, would it be considered that my housing needs were met, or could I argue the point that it would be preferable to own my own home. There are no children involved

Hi! You have a claim to live as you were accustomed to live, how strong that is I do not know but if you have been in your own home for years then you could press for that being your standard of living. There is a space in Form E to write about the standard of living enjoyed by the parties. You do need specialist advice on this one. |
