YES YES YES YES You must submit your own bundle to court!!!!! Along with the form E.

Do not count on your x solicitor to do anything, you need to mirrow what they do and do it yourself.

You get the directions from the court and need to file the documents they request. In this case it will be a form E, a chronology, form G and a statement of issues. Then you give a bundle of YOUR documents to your X solicitor, and they will do the same with you, you then scrutinize them and make questions and file the questions by the date the court needs you to file them.

What happens if the other side still does not agree. Do I just submit a separate bundle to the Court?

As I recall during my hearing, the bundle had to be agreed between both parties. The court rules state this and there was only ever one bundle that the judge referred to.

The bundle comes into its own mainly in the final hearing if it is required. If you have offered documents that you feel should be included then mention it to the judge at the hearing and get the bundle agreed. You can ask that your bundle be used if you feel that it is closer to the truth.

At the first hearing the bundle will hardly be used. It is a preliminary hearing where the judge determines if there is any common ground, whether any deals can be struck. If not he orders that it moves on a stage.

To be honest the whole of the preliminary process of AR is to stop it getting to a Final Hearing. The courts don't want it and realistically nor do you unless you will benefit substantially from it.

From my own experience and what people have written, every one of these hearings is different and designed, with a good judge, to being swift and efficient.
