The judge will ask you if you have questions arising
Form E and if he doesn't you need
to pipe up!!
It will be ordered that you must submit a
questionnaire on his finances by a certain date and he must reply by a
certain date (or his sols), you can ask the questions but he does not have
to answer. The questionnaire format is here on wiki and you must follow it
to the letter as well as the usual court headings. It must be dated and
signed.
If he fails to answer questions and they are relevant to
the case (be careful here and don't get bogged down with minutae) then you
will be able to direct the judge at the next hearing.
You are
well within your rights to ask for company reports, tax returns etc as well
as personal accounts and company accounts for the last 12 months and
projected income etc. Also all personal accounts, credit card statements,
(usually interesting reading!), valuation of properties, cars and anything
else over £500.
If he is a ltd company you can get some detail
from the companys house website. (there is a small fee)
The
first appointment will be to order this info and anything else the judge
requires for a next hearing which will be ordered next week.
