I need some advice. Myself and my ex own a property in the UK
jointly. We emirgrated to Spain in 2005 and subsequently rented out the
property. We divorced here in Spain a year ago and agreed in Spanish court
to sell the house and split the equity 50-50, after repaying a loan from my
parents. Once we have split the equity, my partner will pay me a lump sum
to cover the maintenance for the kids until they are 18 (we have 2) - which
I have
custody of.
We recently got the tenants out of the house and the house has been on
the market for about 9 months now, without having received an offer. I feel
we need to lower the asking price to something more likely to attract
offers so that the house can be sold as soon as possible.
However, my ex will not agree to this, and he also wants to have new
tenants in the house - which is something I do not want given the hassle
and expense we had in getting the previous tenants out. The agent has just
told us the local council are interested in a short term let - which my
partner is interested in, but I am set against.
I want to force
through the sale. How can I go about doing this? Do I need to get my
Spanish divorce settlement recognised in the UK first? If I get a court
order, can I get the house sold at whatever we can get in the way of an
offer, or would it have to go to an auction.
My partner is
being very intransigent, and as they don't earn a lot of money, I'd be left
paying the mortgage once the money in the joint account runs out. They are
also threatening to remove money from the joint account - and has taken
£10,000 during the marriage from the joint account to their personal
account which I have just worked out. I was aware they were moving the
money, but I didn't realise it was so much.
I just want the
house sold asap so that the only time I have to deal with my ex is when we
have to arrange when to hand the kids over for visits.
